The Fair Debt Collection Practices Act (FDCPA), enforced by the Federal Trade Commission (FTC) and private attorneys, prohibits abusive conduct by debt collectors. The FDCPA provides guidelines for debt collectors collecting legitimate debts and provides protections and remedies for debtors.

Anyone who follows news regarding the FDCPA likely knows that lawsuits regarding the act have been in a steady decline over the course of the past year or so. Bearing this in mind, reports have shown that FDCPA lawsuits filed in the second half of July, 2012 are up a massive 36% when compared with those which were filed earlier in the month.

In recent years, there has been a tremendous increase in California debt collector harassment complaints. In fact, from 2006 to 2010, California debt collector harassment complaints have risen by 194%.
