Here are some FDCPA rules that you need to be aware of
Collection of debts through offensive and dishonest means is prohibited. This includes
- Getting in touch with consumers personally or through telephone before 8.00 AM or after 9 PM
- Using foul and abusive language to collect debts
- Continuing to contact the customer in spite of written communication requesting the collector to refrain from contacting him
- Calling the customer at his workplace regardless of instructions not to do so
- Unwarranted threats to arrest or take legal action against the consumer when you are not an attorney or in the legal services
- Disclosing the intent of communication with the consumer to parties other that his spouse or his attorney unless specified by him in writing
- Offering false information on credit reports to prompt quick action on payments
Some tips for furnishing evidence
- Maintain a record of phone calls made by the collectors, the time and content Recording conversations using any telephone recording device would be ideal
- Maintain a file of all communication from debt collectors. Even the font size and words used matter
- Any other paper evidence that could help you establish the facts of the case
